1. Agreement to Terms

By accessing or using Kernel Apps ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these terms, then you may not access the Service.

2. Use License

KernelApps is the app-building and hosting service marketed under the Kernel Apps brand. Subject to your plan, access eligibility and these Terms, you may use it to create and operate personal or business apps. Early-access signup does not automatically activate app creation, AI features or paid services. You may not:

• Copy or resell the platform itself without permission
• Use the Service or app content in a way that infringes another person’s rights
• Attempt to reverse engineer any software contained in the Service
• Remove any copyright or other proprietary notations from the materials

3. User Accounts

When you create an account with us, you must provide information that is accurate, complete, and current at all times. You are responsible for safeguarding the password and for all activities that occur under your account.

4. Acceptable Use

You agree not to use the Service:

• In any way that violates any applicable law or regulation
• To transmit any malicious code or viruses
• To impersonate or attempt to impersonate another user or entity
• To interfere with or disrupt the Service or servers
• To collect or use personal data without a lawful basis and appropriate permissions

Subscriptions, payments and refunds

The pricing page describes plan allowances and availability. When paid plans open, Starter and Pro are monthly subscriptions in USD, before applicable tax. They renew until canceled. Paid upgrades require your confirmation; there are no automatic overage charges or AI top-ups.

For orders processed through Paddle, our order process is conducted by our online reseller Paddle.com. Paddle.com is the merchant of record for those orders and provides payment-related customer service and handles returns. Paddle’s buyer terms apply to checkout. KernelApps provides the software and product support.

Cancellation and downgrades take effect at the end of the current billing period. Cancellation does not automatically refund an earlier charge. See our Refund Policy for requests and statutory rights, and our Privacy Policy for data handling.

5. Intellectual Property

The Service and its original content, features, and functionality are and will remain the exclusive property of Kernel Apps and its licensors. The Service is protected by copyright, trademark, and other laws.

6. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

7. Disclaimer

The information on the Service is provided on an "as is" basis. To the fullest extent permitted by law, Kernel Apps excludes all representations, warranties, and conditions relating to the Service and the use of the Service.

8. Limitation of Liability

In no event shall Kernel Apps, nor its directors, employees, partners, agents, suppliers, or affiliates, be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses.

9. Governing Law

These Terms shall be interpreted and governed by the laws of the jurisdiction in which Kernel Apps operates, without regard to its conflict of law provisions.

10. Changes to Terms

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days notice prior to any new terms taking effect.
